License agreement (EULA)
This License Agreement governs the use of the DeskOne computer software (the “Program”), the right holder of which is Sole Proprietor Aleksei Vladimirovich Kabetov (the “Right Holder”). By installing or using the Program, the User confirms their agreement with the terms of this Agreement.
1. Terms
Computer code (HWID) — an identifier calculated by the Program locally from the computer’s hardware characteristics, without sending to the Right Holder’s server any data that would identify the User.
License key — a unique code that removes the free-mode limit on the device with the corresponding computer code.
Free (trial) mode — operation of the Program without a license key, limited to 2 hours of use per day.
2. Scope of rights granted
2.1. The Right Holder grants the User a simple (non-exclusive), perpetual, worldwide license to use the Program on one computer matching the paid computer code (HWID).
2.2. The Personal license is intended for use by an individual for non-commercial purposes. The license for companies and sole proprietors is intended for use on one workstation in the business of a legal entity or sole proprietor.
2.3. The distinction between personal and commercial licenses is not enforced by technical means and relies on the User’s good faith. Using a personal license in commercial activity violates this Agreement and may entail liability under Article 1301 of the Civil Code of the Russian Federation.
2.4. Any documents, screenshots and other results obtained by the User while using the Program belong to the User; the Right Holder claims no rights to the content of remote access sessions.
3. Restrictions
The User may not: distribute, sell or transfer license keys to third parties; circumvent or modify the license check or the free-mode limits; decompile, disassemble or otherwise attempt to obtain the Program’s source code, except as expressly permitted by Article 1280 of the Civil Code of the Russian Federation; remove or alter copyright notices. Distributing the unmodified installer of the Program, freely available on the official website, is not prohibited.
4. Free mode
The Program is available without payment in a limited mode — up to 2 hours of use per day. The limit applies until a valid license key for the corresponding computer code is entered.
5. Activation and computer code
5.1. The computer code is calculated by the Program locally on the User’s device and does not change when the Program itself is reinstalled. The computer code changes when the operating system is reinstalled or the system drive is replaced — in that case continued use of the license requires a paid key reissue (section 8 of the Public offer).
5.2. The computer code does not contain and does not directly reveal the User’s personal data.
6. Nature of the service and responsibility for access
6.1. DeskOne provides the User with means of remote access to their own devices or to third parties’ devices with their explicit consent. The User is solely responsible for whom they give the connection number and one-time password to, and for all actions performed using the access they provide.
6.2. Remote access sessions are protected by end-to-end encryption; the Right Holder has no technical access to session content — see the Privacy Policy for details.
7. Rights to the Program
The exclusive rights to the Program, its code, design and trademark belong to the Right Holder. This Agreement grants only the right of use and does not transfer any exclusive rights to the User.
8. Updates
The Right Holder may, but is not obliged to, release updates to the Program. Updates within the current version are provided free of charge. New major versions of the Program may be distributed on different licensing terms.
9. Disclaimer of warranties and limitation of liability
9.1. The Program is provided “AS IS”. The Right Holder does not guarantee uninterrupted operation of the Program, the signaling server or the connection under all network conditions.
9.2. The Right Holder is not liable for indirect losses, lost profits or loss of data arising from the use of or inability to use the Program.
9.3. The Right Holder’s aggregate liability to the User is limited to the amount paid by the User for the license.
10. Termination
This Agreement remains in force until terminated by either party. In the event of a material breach of this Agreement, the Right Holder may revoke the User’s license key without refunding the amount paid.
11. Final provisions
11.1. This Agreement is governed by the laws of the Russian Federation.
11.2. If any provision of this Agreement is held invalid, this does not affect the validity of the remaining provisions.
11.3. The Right Holder may amend this Agreement; the current version is always available on the Website.
