Public offer
This document is an official proposal (public offer) of Sole Proprietor Aleksei Vladimirovich Kabetov (the “Contractor”) to conclude an agreement granting the right to use the DeskOne computer software on the terms set out below.
Payment for an order on deskone.ru constitutes full and unconditional acceptance of this offer in accordance with Article 438 of the Civil Code of the Russian Federation.
1. Terms and definitions
Program — the DeskOne computer software intended for remote access to and control of a computer over the internet.
User — an individual or a legal entity (sole proprietor) who has paid for a license to the Program.
License key — a unique set of characters that activates the full (unlimited) version of the Program on one computer.
Computer code (HWID) — an identifier calculated automatically by the Program from the hardware characteristics of the User’s computer; used solely to bind the license key to a specific device.
Connection number (ID) — a short identifier by which one computer finds another to establish a remote access session.
Website — the website located at https://deskone.ru.
2. Subject of the offer
2.1. The Contractor grants the User a simple (non-exclusive) license to use the Program in the manner and on the terms described in the License Agreement, and the User pays a fee for granting such a license.
2.2. The license is granted for one (1) workstation — one computer whose computer code (HWID) was specified by the User when placing the order.
2.3. The license is perpetual. Payment is one-time, with no subsequent subscription or periodic payments.
3. Conclusion of the agreement
3.1. To place an order, the User runs the Program, obtains their computer code (HWID) in the built-in activation window, goes to the Website and enters this code and an e-mail address when placing the order.
3.2. Having checked the order details, the User pays by one of the methods listed in “Payment and refunds”.
3.3. The agreement is deemed concluded (the offer accepted) from the moment the Contractor receives the payment.
4. License price
4.1. Current prices are shown on the Website on the order page and depend on the User category:
- 500 RUB — Personal license, for individuals using the Program for non-commercial purposes;
- 900 RUB — License for legal entities and sole proprietors.
4.2. Prices are stated in Russian rubles and include all applicable taxes. Price changes for future orders do not affect the terms of an order already paid.
5. Provision of the license key
5.1. After payment is received, the Contractor generates a license key bound to the computer code (HWID) specified by the User and sends it to the e-mail address given in the order, and also places it in the User’s account on the Website.
5.2. The key is usually provided within a few minutes of payment; in some cases (technical issues) — within up to 24 hours.
5.3. If the e-mail with the key has not been received, the User should check the Spam folder and their account on the Website and, failing that, contact support at the address given in section 12.
6. Free mode
6.1. The Program can be used without payment and without registration in a limited (free) mode — up to 2 (two) hours of use per day.
6.2. The free mode is intended for getting acquainted with the Program before buying a license. Purchasing a license key removes the daily time limit.
7. Refunds
7.1. The User may cancel the order and receive a full refund of the amount paid at any time before the license key is provided (issued).
7.2. Once the license key has been provided, the order is deemed fully performed and the amount paid is not refundable, except in the case specified in clause 7.3.
7.3. If the Program has a material defect due to which the license key cannot be activated through the Contractor’s fault, and this defect cannot be remedied within 10 (ten) business days of the User’s request, the Contractor makes a full refund of the amount paid.
7.4. The following are not grounds for a refund: the User’s computer not meeting the Program’s technical requirements; an incorrect computer code (HWID) entered in the order (in this case a paid reissue of the key for the correct code is possible — see section 8); the User’s subjective decision to stop using the Program after activation in the absence of a technical defect, since the free mode is available for evaluation before purchase.
8. Reissue of the license key
8.1. If the license key was issued for an incorrect computer code (HWID) through the User’s fault, or the User changed the computer or performed actions that changed the computer code (reinstalling the operating system, replacing the system drive), the Contractor reissues the key for the new computer code upon the User’s request for a separate fee, the amount of which the Contractor communicates individually.
9. Rights and obligations of the parties
9.1. The Contractor undertakes to provide the User with a working license key and to keep the signaling server needed to establish connections between the User’s devices in operation.
9.2. The User undertakes to provide accurate information when ordering (above all, the computer code) and to use the Program in accordance with the License Agreement.
9.3. The Contractor is not liable for the inability to use the Program for reasons beyond the Contractor’s control: failures of the User’s internet provider, power outages, actions of third parties, etc.
10. Liability
10.1. The liability of the parties is determined by the current laws of the Russian Federation and the License Agreement.
10.2. The Contractor’s aggregate liability to the User for any claims related to this offer is limited to the amount actually paid by the User for the license.
11. Personal data
11.1. By placing an order, the User agrees to the personal data processing terms set out in the Privacy Policy and gives the Consent to personal data processing.
12. Final provisions
12.1. The Contractor may unilaterally change the terms of this offer; the current version is always available on the Website.
12.2. All disputes are resolved through negotiations and, failing agreement, in the manner established by the laws of the Russian Federation.
12.3. For any questions related to the performance of the agreement, the User may use the contacts given in the “Contractor details” section.
